What is the Popia Act?

What is the Popia Act?
The Protection of Personal Information Act 4 of 2013 (POPIA) is the comprehensive data protection legislation enacted in South Africa. POPIA aims to give effect to the constitutional right to privacy, whilst balancing this against competing rights and interests, particularly the right of access to information.

What is not Personal Information?
Non-personally identifiable information (non-PII) is data that cannot be used on its own to trace, or identify a person. Examples of non-PII include, but are not limited to: Aggregated statistics on the use of product / service.

When do you have to be compliant by ?
The Protection of Personal Information Act (POPIA) will enter into enforcement on July 1, 2021 and replace the provisions in the ECTA that deal with personal information protection.
